This Privacy Policy describes how Variant Nutrition and our affiliated brands, including (but not limited to) “we”, “us” and “our”, handles personal information that we collect through our digital properties that link to this Privacy Policy, including our website www.variantnutrition.com (“Site(s)”), as well as through social media, our marketing activities, and other activities described in this Privacy Policy (collectively, the “Services”). This Privacy Statement also applies to the personal information we collect offline.

 

Your use of our Services, and any dispute over privacy, is subject to this Privacy Statement and our Terms of Use, including its applicable limitations on damages and the resolution of disputes.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases.   • When you request or purchase products or services from us, we collect information such as your name, e-mail address, shipping and billing address, phone number, order information, including details of products and subscriptions you choose to purchase, and payment information.

  • Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.

  • When you sign up for, or engage with, any of our SMS marketing campaigns. This may include your initial consent, your responses and device information.

  • While you are navigating the Website or using the Services, we may also collect your search queries, information about your viewing history, and other data regarding your use and interaction with the Services for customer or technical support purposes, or to help improve our Services.

  • We may also use your contact information and mailing address for other loyalty or rewards program purposes, such as to send gift packages to you.

  • We may respond to or otherwise engage with social media posts or messages directed at our Variant Nutrition account, or which reference our products. If you publicly share content about us or our products, we may choose to re-post or otherwise share that content with our followers, subject to the terms of the relevant social media platform.

  • Promotion data, including information you share when you enter a competition, promotion, or complete a survey. Please note that if you participate in a contest, or giveaway through the Service, we may ask you for your contact data to notify you if you win, to verify your identity, and/or to send you prizes. In some situations, we may need additional information as a part of the entry process, such as a prize selection choice. These giveaways and contests are voluntary. We recommend that you read the rules and other relevant information for each sweepstakes and contest that you enter.

  • We also collect information that may be reported to government authorities or regulators in accordance with applicable requirements. This information may include your contact information.
     

Third-Party Sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:

  • Public sources, such as government agencies, public records, social media platforms, and other publicly available sources.

  • Private sources, such as data providers, social media platforms, and data licensors.

  • Our affiliate partners, such as our affiliate network provider and publishers, influencers, and promoters who participate in our paid affiliate programs.

  • Marketing partners, such as joint marketing partners and event co-sponsors.

  • Third-party services (such as Google or Apple) that you use to log into, or otherwise link to, your Variant Nutrition account. This data may include your username, profile picture, and other information associated with your account on that third-party service that is made available to us based on your account settings on that service.
     

Automatic Data Collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Site, our communications, and other online services, such as:

  • Device and online activity data. When you visit our Website, we collect technical data including the name of your internet service provider, the website that you used to link to our Website, links you click on or Website, and your IP address. We may also collect information about the length of time you spent visiting our Website and/or using our Services, the referring URL, or the web pages that led you to our Website. We use this data from time to time for statistical purposes, including use of information in de-identified and aggregated format.
     

Cookies: From time to time, we may use “cookies” to keep track of your visit and your use of the Web Properties and to improve your experience on the Web Properties. A cookie is a small piece of data that your browser stores on your computer’s or device’s hard drive and is used to collect information, such as identifying those areas of the Web Properties that you have visited in the past in order to enhance your next visit to the Web Properties. Unique Identifier: We may assign you a unique internal identifier to help keep track of your future visits. We may use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information that you see on the Web Properties and some of the electronic communications you receive from us. We may offer features that help users invite their friends or contacts to use the Service, and we may collect contact details about these invitees so we can deliver their invitations. Please do not refer someone to us or share their contact details with us unless you have their permission to do so.

These companies may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) over time across the Service, our communications and other online services, and use that information to serve online ads that they think will interest you.

 

This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms. Promotions and contests. We may use your personal information to:

  • communicate with you about promotions or contests in which you participate.

To create anonymous, aggregated or de-identified data.  We may create anonymous, aggregated or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated or de-identified data by removing information that makes the data identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.
 

Further uses, in some cases, we may use your personal information for further uses, in which case we will ask for your consent.

How We Share Your Personal Information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection.

Affiliates. We may disclose the information we collect from you to our affiliates, as needed to provide the Services to you, and for other purposes, such as marketing and advertising purposes, and for analytics and measurement purposes.

Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, marketing, consumer research and website analytics).

Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as Stripe or Authorize.Net LLC, who may use your payment data in accordance with their privacy policies.

Advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.

Third parties designated by you. We may share your personal information with third parties where you have instructed us or provided your consent to do so.

Business and marketing partners. Third parties with whom we collaborate on joint activities, with whom we have entered into joint marketing relationships or other joint ventures, or who we think may offer you products or services that you may enjoy.

Linked third-party services. If you log into the Service with, or otherwise link your Service account to, a social media or other third-party service, we may share your personal information with that third-party service. The third party’s use of the shared information will be governed by its privacy policy and the settings associated with your account with the third-party service.

Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

Business transferees. Acquirers and other relevant participants in business transactions (or negotiations and diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Variant Nutrition or our affiliates (including, in connection with a bankruptcy or similar proceedings).

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Your Choices

In this section, we describe the rights and choices available to all users. Users who are located in California, can find additional information about their rights below.

Access or update your information. If you have registered for an account with us through the Site, you may review and update certain account information by logging into the account.

Opt-out of marketing communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.

Linked third-party platforms. If you choose to connect to the Service through your social media account or other third-party platform, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third-party platform, that choice will not apply to information that we have already received from that third party.

Delete your content or close your account. You can choose to delete certain content through your account. If you wish to request to close your account, please contact us.

Mobile location data. You can disable our access to your device’s precise geolocation in your mobile device settings.

Advertising choices. You can limit use of your information for interest-based advertising by:

  • Browser settings. Blocking third-party cookies in your browser settings.

  • Privacy browsers/plug-ins. By using privacy browsers or ad-blocking browser plug-ins that let you block tracking technologies.

The Service may contain links to websites, mobile applications, and other online services operated by third parties (for example, the websites of third-party retailers or distributors of our products websites we link to from the Service). In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. Data Retention

We will keep your personal information for as long as your account is active so that you can access and amend your personal information as necessary, and to provide you access to our Sites. We may continue to retain your personal information after you deactivate your account, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding user preferences, enforce our agreements, or protect our legitimate interests.

If you use certain features on the Variant Nutrition Sites, we may be obligated to keep your personal information for a longer period, and we will do what is legally necessary. When we are no longer required to preserve your personal information, we will ensure that it is securely deleted.

Security Of Your Information

We use technical and organizational security precautions to protect your personal information from manipulation, loss, destruction or unauthorized access, use, disclosure or alteration. Please be aware that despite our efforts, no data security measures can guarantee security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust, unique password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

We are headquartered in the United States and may use service providers that operate in other countries. We may transfer your personal information to the United States or other locations where privacy laws may not be as protective as those in your country, state, or province.

Our website and services are not intended for individuals under the age of 18. We reserve the right to modify this Privacy Policy at any time. California Privacy Rights Notice

This section describes how we collect, use, and share Personal Information of California residents in our capacity as a “business” under the California Consumer Privacy Act (“CCPA”) and their rights with respect to that Personal Information. For purposes of this section, the term “Personal Information” has the meaning given in the CCPA but does not include information exempted from the scope of the CCPA. Our use of some of these services may be classified under California law as a “sale” of your Personal Information to the advertising partners that provide the services because they collect information from our users (e.g., device data and online activity data) to help them serve ads more likely to interest you. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

We will need to verify your identity to process your information, access and deletion requests and reserve the right to confirm your California residency. To verify your identity, we may require government identification, a declaration under penalty of perjury or other information.

Your authorized agent may make a request on your behalf upon our verification of the agent’s identity and our receipt of a copy of a valid power of attorney given to your authorized agent pursuant to California Probate Code Sections 4000-4465. If you have not provided your agent with such a power of attorney, you must provide your agent with written and signed permission to exercise your CCPA rights on your behalf, provide the information we request to verify your identity, and provide us with confirmation that you have given the authorized agent permission to submit the request.

“California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information, if any, to third parties for their direct marketing purposes. To make such a request, please send an email to info@variantnutrition.com . In your request, you must include the statement “Shine the Light Request," and provide your first and last name and mailing address and certify that you are a California resident. We reserve the right to require additional information to confirm your identity and California residency. Please note that we will not accept requests via telephone, mail, or facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

As these rights and your CCPA rights are not the same and exist under different laws, you must exercise your rights under each law separately.”
